1. Introduction and Agreement

1.1 About These Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders, and developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement shall prevail.

These Terms apply to all HALP platforms, including but not limited to:

1.3 Acceptance of Terms

By accessing or using our services, you:

Acknowledge that you have read and understood these Terms
Agree to be bound by these Terms and our Privacy Policy
Represent that you are at least 18 years of age
Represent that you have the authority to enter into this agreement

If you do not agree with these Terms, you must immediately cease using our services.

1.4 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

We will update the "Last Updated" date above
We will notify registered users via email
Material changes will be prominently displayed on our websites
Changes take effect immediately upon posting (or as otherwise specified)

Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

2. Description of Services

2.1 Platform Services

HALP operates specialized property discovery and business directory platforms providing:

Property Services:

House and land package listings and searches
Off-the-plan property information
New development project details
Boutique and luxury property showcases
School zone integration and mapping
Property calculators and tools
Mortgage broker connections
Property market insights and guides

Business Directory Services:

Professional business listings (freemium model)
Enhanced visibility for premium subscribers
Lead generation and inquiry management
Business profile management
Multi-platform advertising reach

Supporting Services:

Property alerts and notifications
Saved searches and favorites
Mortgage and finance calculators
Educational content and buying guides
Market research and data
CRM integration for business users

2.2 Nature of Service

Information Platform: HALP is an information and advertising platform. We:

Facilitate connections between property seekers and property providers
Aggregate and display property and business information
Provide tools to assist in property research and decision-making
Are not a real estate agent, developer, builder, or financial advisor

Lead Routing: When you submit an inquiry about a property listing:

Your inquiry goes directly to the listing agent, developer, or builder
HALP does not store, process, or access property-specific inquiries
The property advertiser is responsible for handling your information
You should review the advertiser's privacy policy before inquiring

When you use our platform inquiry forms (Contact Us, Join Us, Advertise With Us):

Your information is collected and managed by HALP
Inquiries are stored in our CRM systems (Pipedrive, ActiveCampaign)
Supporting information may be stored in Google Drive
This Privacy Policy governs how we handle these inquiries

No Agency Relationship: HALP does not:

Act as your agent or representative
Provide property, financial, legal, or tax advice
Have any authority to bind you to any transaction
Guarantee the accuracy of third-party listings or information
Control how listing agents use your inquiry information

2.3 Service Availability

We strive to provide continuous service availability but:

Services are provided "as is" and "as available"
We may modify, suspend, or discontinue services at any time
Scheduled maintenance may cause temporary interruptions
We are not liable for service interruptions or unavailability

Platform Infrastructure: Our services are delivered through Amazon Web Services (AWS) hosting and backups, Synergywholesale domain hosting, Google Workspace business email, Stripe payment gateway, Pipedrive and ActiveCampaign CRM, and Zapier automation. These providers may change from time to time.

3. User Accounts and Registration

3.1 Account Creation

To access certain features, you may need to create an account. When registering:

You must provide accurate, current, and complete information
You are responsible for maintaining the confidentiality of your credentials
You must be at least 18 years of age
You may only create one account per person
Business accounts require valid ABN/ACN

3.2 Account Security

You are responsible for:

All activities that occur under your account
Maintaining the security of your password
Notifying us immediately of any unauthorized access
Ensuring no other person uses your account

We are not liable for losses arising from unauthorized account use.

3.3 Account Termination

We may suspend or terminate your account if you breach these Terms, provide false information, use your account for fraudulent or illegal activities, fail to pay applicable fees, or your account remains inactive for an extended period. You may terminate your account at any time by contacting us at support@halp.com.au.

4. User Conduct and Prohibited Activities

4.1 Acceptable Use

When using our services, you agree to comply with all applicable laws and regulations, use services only for lawful purposes, provide accurate and truthful information, respect the intellectual property rights of others, and act in good faith when contacting property providers or businesses.

4.2 Prohibited Activities

You must not misuse the platform (bots, scrapers, interference, reverse-engineering), post harmful content (misinformation, malware, spam, phishing, impersonation), engage in illegal activities (fraud, money laundering, IP infringement), abuse or harass other users, or misuse the platform commercially (reselling, competing scraping, multiple accounts).

4.3 Consequences of Violations

Violations may result in immediate account suspension or termination, removal of content or listings, legal action, reporting to law enforcement, or a permanent ban.

5. Property Listings and Information

Property listings and information are provided and owned by property developers and builders, real estate agents and agencies, project marketing companies, and third-party data providers. HALP does not own or control third-party listings, verify accuracy of all listing information, endorse any particular property, or guarantee availability or pricing.

5.2 Information Accuracy

While we make reasonable efforts to ensure accuracy, property information may change without notice; prices, availability, and specifications are subject to change; images and renderings may not reflect final product; land sizes and dimensions are approximate; school zone information is provided for reference only. Always verify critical information directly with the property provider before making decisions.

5.4 School Zone Information

School zone data is sourced from government databases and third-party providers, provided for general reference only, and subject to change based on government policy and enrollment. Always verify school catchment zones directly with the relevant education department and individual schools before making property purchase decisions.

6. Business Directory Listings

To advertise, you must hold a valid ABN or ACN, be a legitimate operating business, comply with all applicable laws, provide accurate business information, and hold necessary licenses. Listings must accurately describe your services, use your own business name and logo, comply with Australian Consumer Law, and must not promote illegal goods, make false claims, violate professional codes, engage in bait advertising, or infringe third-party IP.

Free and Premium subscription tiers are available. Premium subscriptions require payment, are subject to a separate subscription agreement, and auto-renew unless canceled.

7. Payment Terms (Advertiser Subscriptions)

Pricing is as displayed on our website or in the applicable Listing Agreement, subject to change with 30 days notice. All fees are in Australian Dollars (AUD), exclusive of GST unless otherwise stated.

Payments are processed via Stripe (PCI-DSS Level 1 certified), with automatic recurring billing for subscriptions, secure encrypted transactions, and no storage of complete credit card numbers on HALP servers.

Subscriptions auto-renew unless canceled. Cancellation takes effect at the end of the current billing period. No partial refunds for unused time; pro-rata refunds for technical issues preventing service access, processed within 14 business days.

If payment fails, we will attempt to process payment multiple times. Your account may be suspended after 7 days and your listing removed after 14 days. You remain liable for unpaid fees.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us, including logos and trademarks ("HALP", "House And Land Packages", "Boutique Developments"), website design and functionality, software and algorithms, text and graphics, data compilations, and school zone data aggregations.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our platforms for personal, non-commercial purposes.

When you submit content to our platforms, you retain ownership but grant us a worldwide, royalty-free license to use, reproduce, modify, and display your content.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax, or real estate advice. Calculators and tools provide estimates only, are for general information purposes, and should not replace professional advice.

HALP facilitates connections but does not control the conduct of third parties, is not responsible for the actions of property developers, agents, or brokers, does not guarantee the quality of third-party services, and is not party to contracts between you and third parties.

While we strive for accuracy, information may contain errors or omissions. We do not guarantee continuous, uninterrupted access, error-free operation, or absence of viruses.

10. Limitation of Liability

To the maximum extent permitted by law, HALP and its directors, officers, employees, and agents are not liable for direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use our services, errors or omissions in content, third-party conduct or content, unauthorized account access, service interruptions, or property transactions you enter into.

Where liability cannot be excluded, our total liability is limited to $100 AUD for free services or, for paid services, the amount you paid in the 12 months prior to the claim or $1,000 AUD, whichever is less.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law that cannot be excluded.

You agree to indemnify and hold harmless HALP from any claims arising from your breach of these Terms, violation of law or third-party rights, use of our services, content you submit, or interactions with other users or third parties.

11. Dispute Resolution

Before initiating legal proceedings, contact us at legal@halp.com.au with details of your dispute and allow 30 days to investigate and respond.

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales. Optional arbitration in Sydney is available under ADRA rules. To the extent permitted by law, you agree to individual dispute resolution and waive the right to participate in class actions.

12. General Provisions

These Terms, together with our Privacy Policy and any other terms and policies referenced herein, constitute the entire agreement between you and HALP.

If any provision is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary and the remaining provisions will continue in full force and effect.

Our failure to enforce any provision does not waive our right to enforce that provision in the future. You may not assign these Terms without our written consent.

13. Special Terms for Specific Services

Our mortgage calculators provide estimates only, not pre-approvals, use average interest rates and standard assumptions, and should not replace professional financial advice.

School zone information is aggregated from public government databases, provided "as is" without warranty, and subject to change. Enrollment in a school is not guaranteed by living in a catchment zone.

By subscribing to property alerts, you consent to receive emails and SMS notifications based on your saved search criteria.

When we connect you with mortgage brokers, we may receive a referral fee or commission. Brokers are independent third parties, must be licensed, and we do not guarantee loan approval.

You may cancel anytime before your next billing date. There are no refunds for voluntary cancellations, but pro-rata refunds apply for technical issues preventing service access. Refunds are processed within 14 business days.

Liability is excluded to the maximum extent permitted by law, and where it cannot be excluded is capped at $100 AUD for free services or the lesser of $1,000 AUD or the amount paid in the prior 12 months. Nothing excludes rights under the Australian Consumer Law.
